Registering a trademark in Canada is a crucial step in protecting your business's identity. This process ensures that no one else can use a similar mark that might confuse consumers. Below are the essential steps for registering a trademark in Canada and how our trademark lawyer Edmund in Canada can help you secure your intellectual property.
Before registering your trademark, it's vital to conduct a preliminary search in the Canadian Intellectual Property Office (CIPO) database of registered trademarks and pending trademark applications. This ensures that your mark does not conflict with any existing marks. Our trademark lawyer Edmund performs thorough searches to increase the likelihood that your trademark will be accepted by the Canadian Intellectual Property Office (CIPO).
Once it’s confirmed that your trademark is unique in Canada, the next step is to file a trademark application with CIPO. The application must include details about your trademark, such as the name, or logo (if applicable), and the categories of goods or services it will be used for. Our trademark lawyer Edmund will assist you in correctly drafting and submitting the application, ensuring that all details are handled accurately.
After submitting the application, a trademark examiner at CIPO will review it to ensure it meets all legal requirements. During this process, the examiner may issue a report requesting clarifications or modifications. Our trademark lawyer Edmund will respond to these reports and work to overcome any objections that may arise.
If your application meets the requirements, your trademark will be published in the CIPO Trademarks Journal. This allows third parties to file oppositions if they believe your trademark could cause confusion with theirs. Our trademark lawyer Edmund will advise you in case any opposition is filed, defending your application with strong arguments.
If no oppositions are filed or if any oppositions are resolved in your favor, CIPO will proceed to register your trademark. Once registered, your trademark will be protected throughout Canada, giving you the exclusive right to use it in connection with the specified goods or services.
The process of registering a trademark in Canada can be complex and challenging. Our trademark lawyer Edmund, based in Vancouver, has years of experience in protecting trademarks and intellectual property. He will ensure that your trademark is properly protected, from the preliminary search to the final registration. Additionally, he will provide ongoing advice to maintain and defend your trademark against potential infringements.
To ensure that your trademark is properly registered and protected in Canada, contact our trademark lawyer Edmund. With his experience and expertise, you can trust that your trademark is in good hands. Are you planning to secure your brand name or logo in Canada? Registering a trademark with the Canadian Intellectual Property Office (CIPO) is a crucial step. While the official process may look simple, understanding the fee structure is the first hurdle. CIPO's fees are subject to an annual increase, meaning the cost of securing and maintaining your brand protection is constantly rising.
Our Canadian trademark lawyer Edmund Xie can help you strategically navigate these costs and avoid expensive mistakes.
CIPO encourages online filing by offering a reduced fee structure. All fees listed below are in Canadian Dollars (CAD) and reflect the official rates for 2025 and the anticipated increase for 2026.
When you first submit your application, the total cost depends on how many classes of goods or services your brand covers. The fee for the first class, when filed online (the recommended method), is $478.15 in 2025, which is scheduled to rise to $491.06 in 2026. Filing by mail or other means incurs a higher initial fee of $623.27 in 2025, increasing to $640.10 in 2026.
The fee for each additional class of goods or services is a separate charge: $145.12 in 2025, rising to $149.04 in 2026.
A trademark registration must be renewed every 10 years. Renewing your mark online will cost $579.42 for the first class in 2025, scheduled to increase to $595.06 in 2026. The fee for each additional class upon renewal is $180.61 in 2025, rising to $185.49 in 2026. Note that filing the renewal by mail or other means incurs an even higher initial fee ($724.54 in 2025).
The CIPO fees listed above are flat government rates. However, they tell only half the story. The true strategic cost of your trademark application is determined by how you handle the single most important factor: Nice Classification.
CIPO charges that fee for every class after the first. Therefore, how you describe your business and goods and services directly impacts your total official filing cost. The goal is to secure maximum protection under the fewest necessary classes. Filing too broadly leads to CIPO objections and delays, while filing too narrowly leaves parts of your brand unprotected. For instance, a single brand might sell apparel (one class), operate an online store (a second class), and offer design services (a third class), requiring payment for all three.
Other procedural fees are also subject to adjustment. For example, the fee for filing a Statement of Opposition against a competitor's application costs $1,085.76 in 2025, rising to $1,115.08 in 2026.
Your brand is your most valuable asset. Don't let an administrative error or a misplaced class description undermine your protection. As an experienced Canadian trademark lawyer, our goal is not just to file your application, but to ensure your investment is strategic and efficient.
At Alphabetica Law, we help clients:
Minimize Official Fees: We strategically define your goods and services to secure maximum protection under the fewest necessary Nice Classes, saving you money on government fees.
Avoid Office Actions: We prepare the application according to CIPO's strict standards, drastically reducing the risk of time-consuming (and billable) CIPO objections.
